These Terms and Conditions govern your use of the FastValidate website, software and services. By registering for an account or using any part of the service you agree to be bound by these terms. Please read them carefully. It is the express will of the parties that this agreement and all related documents are drawn up in the English language.

This service is provided to individuals who are at least 18 years old, or minors who have parental permission to open and maintain an account. By completing registration you confirm you are eligible.

1. Acceptance of Terms

FastValidate frequently updates and improves its services, which may require changes to these Terms. We may update this agreement from time to time. Continued use of the service after changes are published constitutes acceptance of the updated Terms. You may review the most recent version at any time on this page.

If you do not agree with these Terms, you may not use the website, software or services and must discontinue use immediately.

2. Introduction

This agreement explains our obligations to you and your obligations to us in relation to your use of the FastValidate services. By accessing or using the website, software or services — including creating an account, using the API, or integrating our JavaScript library — you acknowledge and agree to be bound by these Terms and the Privacy Policy.

Definitions

  • "You", "your" or "Client(s)" means legal entities or individuals who register on the website and use it and the software according to these terms.
  • "We", "us" and "our" refers to the FastValidate service, solely created, represented and run by Thomas Aaron Linstead.
  • "Service(s)" refers to the validation services we provide — including email, phone, address and VAT number validation — and the website, software, API and integrations thereof.
  • "API Key" means the private or public authentication key issued to your account to access the FastValidate API.
  • "Terms" means these Terms of Service and all terms, policies and guidelines incorporated by reference, including the Privacy Policy.

3. Services

FastValidate provides members with services to validate email addresses, phone numbers, postal addresses and EU VAT numbers. Unless explicitly stated otherwise, any new features that augment or enhance the current service are subject to these Terms.

You understand and agree that the service is provided "as-is". FastValidate assumes no responsibility for timeliness, deletion, mis-delivery or failure to store any user communications, documents or personalisation settings.

FastValidate reserves the right at any time to modify or discontinue, temporarily or permanently, the service or any part thereof, with or without notice. The site may be subject to scheduled and unscheduled outages. We will use reasonable efforts to restore the service after any unscheduled downtime.

4. Subscription Plans & Billing

In consideration for services received, you shall pay FastValidate the monthly service fee for the applicable plan. Current rates are listed on the pricing page. FastValidate reserves the right to adjust its rates at any time; changes will be communicated with reasonable notice.

Billing is monthly, charged on the 1st of each month. Your first invoice is a pro-rata amount for the remaining days in the current billing period.

Your usage of the FastValidate service is limited by your subscription plan. You shall not exceed the validation limits associated with your account tier. Unused validations do not carry over from one monthly period to the next. If you exceed your monthly limit, the service may be restricted and return an error response until the next billing cycle.

Payment is processed securely through Stripe. FastValidate does not store card details. You agree to provide accurate billing information and keep it up to date.

Cancellations & Refunds. You may downgrade to the Free plan at any time from your account settings. Your paid subscription will remain active until the end of the current billing period; no partial refunds are issued for unused time. If you believe you have been incorrectly charged, contact us at fastvalidate@sitehome.app within 30 days of the charge.

Failed Payments. If payment cannot be collected on the scheduled billing date, FastValidate will attempt to notify you by email. If payment remains outstanding for 14 days following the due date, we reserve the right to downgrade your account to the Free plan at our discretion. From that point your API access will be limited to Free plan quotas. Your account data and request history are retained in full — no data is deleted due to non-payment. You may restore a paid subscription at any time by updating your payment details and re-subscribing from the billing page.

5. Account Security

All passwords are encrypted using a strong one-way hashing algorithm and are never stored in plain text. You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your account.

You agree to: (a) immediately notify FastValidate of any unauthorised use of your password or account or any other breach of security; and (b) ensure you exit from your account at the end of each session. FastValidate cannot and will not be liable for any loss or damage arising from your failure to comply with this section.

6. API Keys & Permitted Use

Upon registration you are issued API keys to authenticate requests to the FastValidate service. You are responsible for keeping your API keys confidential. You must not share, publish, embed or otherwise expose your private API key to third parties or in public repositories.

You may embed your public API key in client-side code (such as our JavaScript library) for the purpose of validating data on your own web forms. You must not use FastValidate's service to:

  • Resell, sublicense or make the validation API available to third parties as a standalone service.
  • Scrape, enumerate or bulk-validate data in a manner inconsistent with your subscription plan's rate limits.
  • Submit data you do not have lawful authority to process.
  • Attempt to reverse engineer, circumvent usage limits, or interfere with the service infrastructure.

FastValidate reserves the right to suspend or terminate any API key that is found to be in breach of these terms, or where misuse is suspected.

7. Disclaimer

YOU EXPRESSLY UNDERSTAND AND AGREE THAT FASTVALIDATE DOES NOT WARRANT THAT THE SERVICES ARE COMPLETELY ERROR-FREE OR UNINTERRUPTED. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. FASTVALIDATE EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

Validation results are indicative only. FastValidate does not guarantee that an email address exists and will receive mail, that a phone number belongs to a specific individual, or that an address is currently occupied. You should not make decisions that could cause harm solely on the basis of a validation result.

No advice or information, whether oral or written, obtained from FastValidate through or from the service shall create any warranty not expressly stated in these Terms.

8. Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT FASTVALIDATE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES RESULTING FROM: (i) THE USE OR INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES; (iii) UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.

Where liability cannot be excluded by law, FastValidate's total aggregate liability to you for any claim arising out of or in connection with these Terms shall not exceed the total fees paid by you to FastValidate in the three months preceding the claim.

9. Intellectual Property

The FastValidate name, logo, website, software and documentation are the intellectual property of Thomas Aaron Linstead. Nothing in these Terms grants you any right or licence to use the FastValidate name, logo or any other proprietary material except as expressly permitted in writing.

You retain ownership of all data you submit to the service for validation. By submitting data you grant FastValidate a limited, non-exclusive licence to process that data solely for the purpose of providing the validation service.

10. Force Majeure

Our delay in or failure to perform any services under this agreement shall be excused if such delay or failure is caused by strike, fire, flood, earthquake, acts of nature, governmental action, failure of suppliers, communications line failures, power failures or any other cause or event beyond our reasonable control. In such instances we agree to resume performance of the services as soon as commercially feasible.

11. Governing Law

These Terms and the relationship between you and FastValidate shall be governed by the laws of England and Wales, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
